Weekly Repayments

*“Weekly repayments” are based on a discounted rate of 3.84% pa variable (2 yr introductory rate principal and interest repayments based on 30 year loan term, rates are subject to change at any time without notice)(Comparison rate 4.39%pa) with finance being provided through Australian Home Mortgage ASIC Licence number 38859. Horizon Collection appraised rental returns

The “appraised rental return of 5.20%” is based upon a 2 bedroom Horizon Collection home with a property value of $309,800 returning $16,120 per annum ($310 per week rent). Property values and rates of return/rental income are subject to market conditions and fluctuations and as such the Gross Rental Yield is indicative only and subject to change. If for example, a rental price of $300 per week, rather than $310 per week was achieved, the Gross Rental Yield would drop. Ecco Ripley AAPT Defence Gift Card Promotion

The Promotion is for a limited time only (see Promotion Period at clause 1.3 below) and is subject to the terms and conditions outlined below, which are available on the Promotion website: www.eccoripley.com.au/defence (Promotion Website). The Promotion only applies to the Eligible Lots (see clause 4.1 below). The Promotion and any material associated with the Promotion do not form part of any contract for the purchase of any Eligible Lots or any building contract.
1. PROMOTION DETAILS
1.1. The Promotion only applies to Eligible Lots in the ‘Ecco Ripley’ estate at Ripley, Queensland (Ecco Ripley).
1.2. In these terms and conditions:
(a) ‘Sekisui House’ means Ripley Town Holdings Pty Ltd ACN 112 588 217, the promoter and the entity which owns and is selling land within Ecco Ripley; and
(b) ‘Agent’ means Sekisui House Realty (Qld) Pty Limited ACN 603 274 273 with licence number 3900632.
1.3. The Promotion commenced on 23 August 2020 at 10.00am (AEST) and concludes on 31 December 2020 at 5:00pm (AEST) (Promotion Period) unless all Eligible Lots are sold out earlier. Sekisui House may extend the Promotion Period at its sole discretion (Extended Promotion Period). Details of any Extended Promotion Period will be posted on the Promotion Website. References in these terms and conditions to the Promotion Period include any Extended Promotion Period, where applicable.
1.4. The Promotion details set out in these terms and conditions are correct at the time of their first publication, but may change at Sekisui House’s absolute discretion at any time. Sekisui House will post any changes to the Promotion (including these terms and conditions) on the Promotion Website.
2. ELIGIBILITY CRITERIA
2.1. To be eligible for the Promotion, a person or person(s) must:
(a) be an individual (Buyer) and provide evidence to Sekisui House’s satisfaction that the Buyer is a member of the Australian Defence Force; and
(b) during the Promotion Period, sign a valid and binding contract for an Eligible Lot in Ecco Ripley:
(i) which is either:
(A) a vacant land contract; or
(B) a house and land contract (where Sekisui House is the seller of both the house and land in the one contract);
(ii) which contains a condition regarding the Gift Card being a rebate; and
(iii) on terms which are acceptable to Sekisui House and comply with Sekisui House’s requirements for contracts for the purchase of Eligible Lots as determined in its absolute discretion, and
(Eligible Contract);
(c) before the end of the Promotion Period:
(i) complete and submit the online enquiry form at eccoripley.com.au/defence; and
(ii) deliver an original signed Eligible Contract to an authorised representative of Sekisui House or the Agent at the Ecco Ripley sales centre at Shop 1/20 Main Street, Ripley, Queensland (Sales Centre);
(d) effect settlement under the Eligible Contract;
(e) not transfer or assign any interest in the Eligible Contract to a third party on or before settlement of the Eligible Contract; and
(f) be 18 years of age or older at the date of commencement of the Promotion,
and otherwise comply with these terms and conditions
(Eligibility Criteria).
2.2. If the Eligible Contract meets the criteria set out in clause 2.1, Sekisui House will sign the Eligible Contract.
3. GIFT CARD
3.1. Buyers who comply with the Eligibility Criteria will be eligible to receive upon or following settlement of the Eligible Contract, 1 x Gift Card to the value of $1,000.00 which can be used at any retailer at the Ripley Town Centre located at 20 Main Street, Ripley, Queensland (Gift Card).
3.2. In respect of the Gift Card:
(a) the Gift Card is subject to these terms and conditions and is not transferable, nor redeemable or exchangeable for monetary payment or a discount or rebate on the purchase price of an Eligible Lot unless agreed to by Sekisui House (at its absolute discretion);
(b) the Gift Card may expire or become void and may not be redeemed if it expires or is lost, defaced, stolen, damaged, altered or otherwise damaged or tampered with in any way;
(c) neither Sekisui House nor its related entities will be liable to replace or reissue a Gift Card or reimburse any remaining dollar value on any Gift Card which is expired, lost, defaced, stolen, damaged, altered or otherwise damaged or tampered with in any way; and
(d) redemption of the Gift Card is subject to the provider’s terms and conditions. Contact the relevant provider for those terms and conditions.
3.3. The Gift Card must be reflected as a rebate on the transfer documents for the Eligible Lot as required by law and must be disclosed by the Buyer to any financier of the Buyer before settlement of the Eligible Contract.
3.4. Where there is more than one Buyer noted on an Eligible Contract (for example, where Buyers are purchasing jointly or as tenants in common), a Gift Card will only be provided once to the Buyers, jointly. A Gift Card is provided only once per Eligible Lot and subject to compliance with the Eligibility Criteria.
3.5. Sekisui House may, in its sole discretion, make an equivalent cash payment to a Buyer in lieu of a Gift Card.
3.6. Buyers acknowledge and agree that any failure to comply with the Eligibility Criteria or these terms and conditions will make the Buyer ineligible for this Promotion. In the event of any dispute as to eligibility for the Promotion, eligibility will be determined by Sekisui House having regard to these terms and conditions, and Sekisui House’s decision will be final and binding.
4. ELIGIBLE LOTS
4.1. This Promotion only applies to:
(a) vacant land only lots in Ecco Ripley;
(b) house and land packages in Ecco Ripley where Sekisui House is the seller of both the house and land in the one contract; and
(c) duplexes,
which are available for purchase from Sekisui House through the Sales Centre during the Promotion Period and where the Agent (and no other person) is the effective cause of the sale of the Eligible Lot and specifically:
(i) excludes any lot subject to a put and/or call option agreement (including a sale by way of a third party contract under such put and/or call option agreement) whether or not the Buyer is aware of this; and
(ii) excludes any lot subject to an exclusive hold arrangement by a builder or other third party (whether or not the Buyer is aware of this),
(Eligible Lots).
4.2. Subject to clause 4.3, Sekisui House may vary the Eligible Lots at its sole discretion before or during the Promotion Period. Details of the Eligible Lots as varied from time to time will be posted on the Promotion Website. It is the Buyer’s responsibility to enquire with Sekisui House as to whether any lot is included or excluded from the Promotion as per the above before entering into any contract.
4.3. Sekisui House reserves the right to withdraw any Eligible Lot from the Promotion provided that Eligible Lot has not become subject to a binding Eligible Contract during the Promotion Period. Eligible Lots which become subject to an Eligible Contract during the Promotion Period will be removed from the Promotion, but may be re-listed as Eligible Lots at Sekisui House’s absolute discretion if the sale does not proceed.
5. DELIVERY OF THE GIFT CARD
5.1. Subject to the Buyer satisfying all Eligibility Criteria, Sekisui House will at its election (in its absolute discretion) deliver the Gift Card to the Buyer either:
(a) at settlement of the Eligible Contract; or
(b) within 14 days after settlement of the Eligible Contract.
5.2. Buyers who are entitled to a Gift Card which has not been delivered at settlement of the Eligible Contract will be telephoned or otherwise contacted by Sekisui House or an agent of Sekisui House and asked to provide an address for the Gift Card to be mailed to by registered post or delivered by courier. The identities of the Buyers entitled to a Gift Card will not be published in any other way.
5.3. If Sekisui House, after using reasonable endeavours, cannot contact a Buyer within 3 months after settlement of the Eligible Lot, the Buyer’s entitlement to the Gift Card will be forfeited and the Buyer will have no claim or recourse against Sekisui House.
5.4. Buyers may receive one or more gift cards making up the total $1,000.00 value of the Gift Card.
6. GENERAL
6.1. The Promotion cannot be used in conjunction with any other promotion or offer relating to an Eligible Lot, unless agreed by Sekisui House in writing.
6.2. By delivering any contract to purchase an Eligible Lot to Sekisui House (or the Agent) for the purposes of this Promotion, the Buyer is deemed to have accepted these terms and conditions.
6.3. The Promotion may be withdrawn at Sekisui House’s discretion and these terms and conditions may be amended by Sekisui House at any time during the Promotion Period.
6.4. Failure by Sekisui House to enforce any of its rights under these terms and conditions or an Eligible Contract does not constitute a waiver of those rights.
6.5. In the event of any dispute as to eligibility to participate in the Promotion, eligibility will be determined by Sekisui House and Sekisui House’s decision will be final and binding.
6.6. Sekisui House may in its absolute discretion waive strict compliance with the Eligibility Criteria on a case by case basis.
6.7. Sekisui House will not be liable for any loss or damage suffered or incurred by any person who relies upon the information in any advertisement relating to the Promotion or participates in the Promotion (except for any liability which cannot be excluded by law), nor for any restriction of Sekisui House’s ability to provide any aspect of the Promotion as a result of the act of any third party, its employees or agents.
6.8. Nothing in these terms and conditions or any Eligible Contract limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or other consumer protection laws in Queensland which cannot be contracted out of (Non-Excludable Guarantees).
6.9. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Sekisui House (including its respective officers, employees and agents) will not be liable for any liability, for any personal injury, or any loss or damage, whether direct, indirect, special or consequential, arising in any way out of the Promotion.
6.10. Sekisui House gives no warranty and makes no representation as to the accuracy or sufficiency of any description, illustration, photograph or statement contained in any advertisement, or any information or statements made or given by its employees, agents or contractors concerning the Promotion, and will not be liable for any loss or damage suffered or incurred by any party who relies upon the information in any such advertisement, publication or statement except for any liability which cannot be excluded by law.
6.11. This Promotion is governed by the laws in Queensland.
